Terms of Service

By using the netdesk.au website and making use of a NetDesk account (the "Account") and all its related features and services (the "Services"), you agree to be bound by the following terms of service (the "Terms"). These Terms cover all present and future features provided by your Account. The Services are operated by NetDesk Pty Ltd ("We", "the Company"), an Australian business (ACN 111 222 333) located in Melbourne, Victoria, Australia. Use of your Account or the Services includes registering an Account, keeping an Account open (not deleted by you or not deleted or deactivated by NetDesk Pty Ltd), or accessing our website or making use of our services. Please read these Terms carefully before you use your Account or the Services. By using your Account or the Services, you are agreeing to be bound by these Terms. You may not use your Account or the Services if you do not agree to these Terms. These Terms apply every time you use your Account or the Services.
1. Users of the Services
The Services are provided exclusively to individuals who are at least 18 years of age. Users under 18 must obtain parental or legal guardian consent to open and maintain an Account.
The Services are provided exclusively to persons or legal entities. Accounts registered by "bots" or automated methods are not authorized and will be terminated.
The Services are available to residents of Australia only. We do not provide services to persons outside of Australia.
Each user is solely responsible for all actions performed through the Services.
2. Service Description
NetDesk Pty Ltd provides remote IT support services through 15-minute sessions at AUD $20 per session. Support is delivered via remote desktop access using Zoho Assist, with your explicit consent required before a technician may access your device.
Sessions are conducted via phone call. Calls are recorded solely for the purpose of generating a transcript for billing and dispute resolution. The audio recording is deleted immediately after the transcript is produced. Transcripts are retained for two years.
3. Account Registration
To use our Services, you must create an Account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.
4. Payment Terms
Payment is required before each support session. We accept credit and debit cards via Stripe. All fees are in Australian Dollars (AUD) and are inclusive of GST where applicable.
A session that ends in under 3 minutes is automatically voided and you will not be charged.
If you wish to continue a session beyond the initial 15 minutes, you must provide consent — either verbally during the call or by replying YES to a confirmation SMS — before an additional session block can be charged.
If a session is disrupted due to a fault on our end (such as a system or platform failure), we will issue a free session credit to your Account, valid for future use.
All fees are non-refundable except as required by Australian Consumer Law or as outlined above.
5. Session Cancellation
You may cancel a booked session from your portal before it begins. Cancellations made before the session starts will not incur a charge.
Once a session has started, the standard session fee applies (subject to the 3-minute void rule in §4).
6. Acceptable Use
You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. You agree not to attempt to gain unauthorized access to any Services, accounts, or networks.
7. Intellectual Property
The Services and all content, features, and functionality are owned by NetDesk Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws.
8. Privacy
Your use of our Services is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.
9. Limitation of Liability
To the maximum extent permitted by law, NetDesk Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
10. Termination
We may terminate or suspend your Account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by email and by updating the "Last modified" date on this page. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

14. Miscellaneous
These Terms do not affect your statutory rights or your legal rights as a consumer under Australian Consumer Law.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.
These Terms represent the entire agreement between you and NetDesk Pty Ltd in connection with your use of your Account or the Services, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written between you and NetDesk Pty Ltd with respect to your Account or the Services.
